Scoop Addict LLC

These Terms of Service ("Terms") govern your access to and use of the Scoop Addict platform, website, marketplace, checkout, account features, and related services (collectively, the "Platform"). By accessing or using the Platform, creating an account, placing an order, or otherwise interacting with Scoop Addict, you agree to these Terms and all policies incorporated by reference.
If you do not agree to these Terms, you may not access or use the Platform.
1. Platform Overview
Scoop Addict LLC operates a curated online marketplace connecting customers with independent third-party curators who may offer mystery scoops, curated bundles, and related products for sale.
Scoop Addict does not manufacture, own, store, or ship curators products. Scoop Addict is not the seller of record for curators products unless expressly stated in writing. Scoop Addict facilitates marketplace access, order processing, and payment processing on behalf of independent curators.
All purchases made through the Platform are made from independent curators through the Scoop Addict marketplace.
2. Incorporated Policies
These Terms incorporate by reference any policies posted or made available by Scoop Addict, including the Refund and Exchange Policy, Shipping Policy, Privacy Policy, curator Policies, Marketplace Rules, and any order-specific terms shown at checkout. If there is a conflict between these Terms and a policy, Scoop Addict may determine which provision applies based on the specific issue, except where applicable law requires otherwise.
3. Eligibility
You must be at least 18 years old to use the Platform or make purchases. By using the Platform, you represent that you have the legal authority to enter into these Terms.
4. Accounts
You are responsible for maintaining accurate account information, protecting your login credentials, and all activity under your account. You agree to promptly notify Scoop Addict of any unauthorized access or suspected security issue. Scoop Addict may suspend, restrict, or terminate accounts at its discretion when necessary to protect customers, curators, the Platform, or legal compliance.
5. Purchases and Payments
All transactions are processed through third-party payment providers. By purchasing through the Platform, you represent that your payment information is accurate, authorized, and lawfully used. You are responsible for all charges incurred through your account or payment method.
Scoop Addict facilitates payment processing but is not the seller of record for curator products unless expressly stated in writing.
6. All Sales Final and Refund Limits
All purchases are subject to the Scoop Addict Refund and Exchange Policy. Unless otherwise required by law or expressly approved under the applicable policy, all sales are final.
Refunds, exchanges, replacements, or credits may be limited to damaged, defective, incorrect, missing, or materially misrepresented items, as determined by Scoop Addict and applicable policies. Dissatisfaction with the contents, value, assortment, style, rarity, or personal preference related to a mystery item does not, by itself, create a valid refund claim.
· Product contents may vary.
· Perceived value may differ from customer expectations.
· Mystery items are not guaranteed to meet individual preferences.
· Variability is part of the purchasing experience.
7. Assumption of Risk for Mystery Products
By purchasing a mystery scoop, curated bundle, or similar product, you acknowledge and accept the inherent uncertainty of mystery-based purchases. You understand that product contents are not guaranteed unless specifically stated in the listing, and you assume the risk that the items received may not match your personal expectations.
8. Marketplace Disclaimer and Curators Responsibility
curators are independent third parties and are not employees, agents, partners, or representatives of Scoop Addict. Scoop Addict does not control and does not guarantee curator products, product quality, product safety, product legality, listing accuracy, inventory, shipping performance, or curator conduct.
Each curators is responsible for its listings, products, packaging, fulfillment, customer communications, shipping, returns, exchanges, and compliance with applicable laws. Scoop Addict may review disputes or policy concerns, but is not obligated to provide refunds, replacements, credits, or other remedies except as required by law or applicable policy.
9. Shipping and Delivery
curators are solely responsible for shipping, delivery, handling times, packaging, fulfillment, and providing accurate shipping-related information unless Scoop Addict expressly states otherwise.
Scoop Addict is not responsible for carrier delays, lost or stolen packages, delivery failures, incorrect addresses provided by customers, weather delays, customs delays, or other shipping issues outside Scoop Addict's direct control. Remedies, if any, are governed by the applicable Shipping Policy, Refund and Exchange Policy, curator terms, carrier rules, and applicable law.
10. Taxes
As a marketplace facilitator, Scoop Addict is responsible for calculating, collecting, and remitting applicable sales tax on transactions processed through the platform in jurisdictions where marketplace facilitator laws apply. curators are not responsible for sales tax on orders fulfilled through Scoop Addict where the marketplace facilitator obligation applies.
Customers are responsible for any applicable duties, customs charges, or similar assessments on international orders that are not collected at checkout.
curators remain solely responsible for their own income tax obligations, business taxes, and any tax reporting requirements arising from their sales activity on the platform. Scoop Addict does not provide tax advice. curators are encouraged to consult a qualified tax professional regarding their individual obligations.
11. User-Generated Content
Users may be permitted to submit reviews, comments, messages, photos, feedback, or other content through the Platform. You agree that any content you submit must be truthful, lawful, non-infringing, and not abusive, deceptive, defamatory, discriminatory, harassing, obscene, or otherwise inappropriate.
By submitting content, you grant Scoop Addict a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, display, distribute, edit, moderate, remove, and promote that content in connection with the Platform, marketing, customer support, dispute review, and business operations.
Scoop Addict may moderate, remove, restrict, or refuse user-generated content at its discretion. Scoop Addict is not responsible for user-generated content posted by customers, curators, or other third parties.
12. Prohibited Conduct
You may not engage in conduct that violates law, these Terms, or Scoop Addict policies, including fraud, deceptive practices, abusive or fraudulent chargebacks, circumvention of the Platform, off-platform transactions, misuse of platform systems or data, unauthorized scraping, security interference, harassment, or unlawful activity. Violations may result in order cancellation, account suspension, account termination, denial of claims, reporting to payment processors, or legal action.
13. Disputes, Claims, and Chargebacks
Customers are encouraged to contact the curators directly through the Platform to resolve order issues before initiating a formal dispute or chargeback. Most shipping concerns, damaged item issues, order discrepancies, or product concerns can be resolved more quickly through direct communication.
If a resolution cannot be reached, customers may escalate the matter through Scoop Addict. Scoop Addict may review the issue, communications, order records, photos, delivery records, curators information, and other supporting evidence. Scoop Addict may make a final determination in accordance with these Terms, the applicable policies, payment processor rules, and applicable law.
Customers are encouraged to contact Scoop Addict before initiating a chargeback with their payment provider. Failure to attempt resolution through the Platform may limit Scoop Addict's ability to assist and may be considered in dispute evaluations.
Scoop Addict may use transaction data, communications, delivery records, account history, usage data, policies, and order confirmations to investigate fraud, enforce policies, respond to disputes, and defend against chargebacks.
14. Intellectual Property
All Platform content, branding, design, text, graphics, logos, images, software, and other materials owned or controlled by Scoop Addict are protected by intellectual property laws and may not be copied, reproduced, distributed, modified, or used without permission.
curators retain ownership of their listings, photos, descriptions, shop names, and related content, but grant Scoop Addict a non-exclusive, worldwide, royalty-free license to use, display, reproduce, promote, distribute, edit, and make available such content in connection with the Platform, marketing, customer support, dispute resolution, and marketplace operations.
You represent that you own or have proper authorization to upload, submit, or license any content you provide to the Platform.
15. Disclaimers
The Platform and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Scoop Addict disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, product quality, product satisfaction, value, rarity, outcome, uninterrupted access, and error-free operation.
Scoop Addict does not guarantee the accuracy of curators listings, the quality or safety of curators products, customer satisfaction, uninterrupted service, or any specific result from using the Platform.
16. Limitation of Liability
To the fullest extent permitted by law, Scoop Addict is not liable for curator actions or omissions, product quality or performance, shipping or delivery issues, customer dissatisfaction with mystery items, lost profits, lost data, indirect damages, incidental damages, consequential damages, punitive damages, or any damages arising from use of or inability to use the Platform.
To the fullest extent permitted by law, Scoop Addict's total liability for any claim shall not exceed the amount paid by the customer for the transaction giving rise to the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless Scoop Addict LLC, its members, managers, officers, employees, contractors, service providers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Platform, your violation of these Terms, your violation of law, your content, your misuse of payment or dispute processes, or your dispute with any curator or third party.
18. Suspension and Termination
Scoop Addict may suspend, restrict, or terminate your access to the Platform at any time if Scoop Addict determines that you violated these Terms, violated applicable policies, engaged in fraud or abuse, created risk for customers, curators, payment processors, or the Platform, or otherwise acted in a manner inconsistent with the integrity of the marketplace.
Upon termination, your right to use the Platform ends immediately. Any obligations that arose before termination remain in effect.
19. Legal Notices
All formal legal notices, demands, claims, dispute notices, breach notices, termination notices, arbitration or mediation notices, or other official communications relating to these Terms, the Platform, any order, curator transaction, account, policy, or legal claim must be provided in writing and sent in accordance with this section.
Formal legal notices, claims, disputes, or other official communications should be sent in writing to support@scoopaddict.com and should include “Legal Notice” in the subject line. Scoop Addict may request additional information or a mailing address if needed to process the notice.
A legal notice must include enough detail for Scoop Addict to identify the issue, the party involved, any order or curator transaction at issue, the requested action, and any applicable deadline.
Communications sent through social media, text message, online comments, reviews, curator messaging, general chat, or other informal channels will not be considered formal legal notice unless Scoop Addict expressly confirms in writing that the communication has been accepted as legal notice.
Scoop Addict may provide legal, account, transaction, dispute, policy, or other official notices to customers, users, and curators by email, account notice, platform dashboard notice, order page notice, written mail, certified mail, courier, website posting, or any other method permitted by law.
Customers, users, and curators are responsible for keeping their account information, email address, mailing address, and contact information accurate and current. Scoop Addict is not responsible for missed notices caused by outdated, incorrect, inactive, or inaccessible contact information.
Unless otherwise required by law, notices will be considered received as follows: email upon transmission if sent to the most recent email address on file and no delivery failure notice is received; platform, account, dashboard, or order page notice when posted, sent, or made available; certified mail, courier, or other trackable delivery upon delivery, refusal of delivery, or attempted delivery; first-class mail three business days after mailing; and website posting when posted or made available on the Scoop Addict website or marketplace.
20. Arbitration, Class Action Waiver, and Small Claims
Except where prohibited by law, disputes arising out of or relating to these Terms, the Platform, any purchase, any curator transaction, or any related policy shall be resolved through binding individual arbitration administered under the rules of the American Arbitration Association, unless the dispute qualifies for small claims court.
You and Scoop Addict waive the right to a jury trial and the right to bring or participate in a class action, collective action, consolidated action, private attorney general action, or representative proceeding.
This section does not prevent either party from seeking temporary, preliminary, or permanent injunctive relief for intellectual property misuse, unauthorized platform access, fraud, security threats, or other claims where equitable relief is appropriate.
21. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.
22. Force Majeure
Scoop Addict is not liable for delay or failure to perform caused by events beyond its reasonable control, including carrier disruptions, curator delays, natural disasters, severe weather, labor disruptions, supply chain interruptions, system outages, cyber incidents, payment processor issues, acts of government, emergencies, or other events outside Scoop Addict's control.
23. Changes to Terms and Policies
Scoop Addict may update these Terms or related policies from time to time. Notice may be provided by email, website posting, account notice, platform notice, or other reasonable method. Continued access to or use of the Platform after updated terms or policies are posted or communicated constitutes acceptance of those updates, unless otherwise required by law.
24. Miscellaneous
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
No Waiver. Scoop Addict's failure to enforce any provision is not a waiver of its right to enforce that provision later.
Entire Agreement. These Terms and incorporated policies constitute the entire agreement between you and Scoop Addict regarding use of the Platform.
Assignment. You may not assign your rights or obligations under these Terms without Scoop Addict's prior written consent. Scoop Addict may assign these Terms as part of a merger, acquisition, sale of assets, reorganization, or business transfer.
Headings. Section headings are for convenience only and do not affect interpretation.
Survival. Sections that by their nature should survive termination will survive, including payment obligations, dispute provisions, disclaimers, limitation of liability, indemnification, legal notices, and miscellaneous provisions.
